This Contract is between the Client, whose name and address is listed above and White Ink Photography. This Contract establishes that all services/products have understood and accepted by the Client.  Upon signing this Contract all sales are final.  
I hereby consent that photographs taken by White Ink Photography may be reproduced in both printed and online form by White Ink Photography for the purpose of display, portfolio, advertising, and website to promote her products/name. I also agree that these images may be used without additional compensation to the undersigned. *In some cases Facebook images may not be posted if noted by the Client.

Cooperation/No Shows: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. Re-shoots are determined at the discretion of the photographer. I will be choosing the best of the best images to edit and present to you so if you see anything that you don’t care for during the session please let me know.  I want to make sure I’m providing you with pictures that you will love.  My  editing workflow includes brightening, removing any baby acne and prominent skin flakes, reducing redness and yellowing caused by jaundice, softening skin to even out blotchiness and give a smooth texture, and sharpening to bring out features. Please note, again, there no refunds or exchanges on fees paid due to the custom nature of portrait photography.
Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders Photographer’s ability to obtain quality shots.  If Client and/or key individuals fail to appear to a scheduled portrait session, the $50/$100 retainer is non-refundable. The session can be rescheduled at the original portrait session fee.
Newborn Session- A typical newborn session lasts 3-4 hours. In order to guarantee the client 18-25 images, the photographer must complete her typical workflow before attempting any special requests from the client. The completions of all special requests are left to the discretion of the photographer. If it is determined by the photographer (in the rare case) that your newborn session needs to be rescheduled within the first 45 minutes - 1hr of your session, the photographer will reschedule your newborn session at no charge. However, if a newborn shoot needs to be rescheduled after the first 45 minutes - 1hr of a session, a $100 rescheduling fee will apply. Any sessions exceeding 4 hours will include an additional fee of $50 an hour. Rescheduling your session is left to the discretion of the photographer. 

Print & Product Information: If digital files are a part of the purchase, your purchase of the original files releases Amanda Tekin from any liability due to loss or damage of the images, and also releases from any obligation to maintain copies of any digital file, image, or photograph. Client is not required to print their images through White Ink Photography. 
Online Galleries: Gallery opens within 14 days from the session date and expire 14 days from the opening. If an order is not placed during this time a $25 re-post fee will apply. Images are kept on file for one year from the date of the session and are purged thereafter. 
Turnaround Time- Galleries will be available/posted est. 3 weeks from date of session unless otherwise noted.
All galleries will host the best of the best digital files that White Ink Photography chooses to edit. This will always be a nice variety of images that we were able to capture during our session. White Ink Photography has never and will never give a client all images taken the day of the session. Any questions regarding this please ask.

Orders: Payment is required once order is received. Please allow 10-14 for orders to be processed and shipped. Orders which include custom products; however, may require more time for processing. If orders are to be delivered, White Ink Photography will be in touch to set up a convenient time to do so.

Copyright Policy: The federal Copyright Act protects all professional photographers by giving us the exclusive rights to reproduce the photographs from your session.
Amanda Tekin of White Ink Photography retains all copyrights to all session images and reserves the right to use images for promotional or competitive purposes. You may not screenshot images from your gallery, or alter watermarked images in any way as this would be a Copyright offense. 

This Agreement incorporates the entire understanding of the Parties, and the Parties agree to all its terms, and acknowledge receipt of a completed copy of the Agreement signed by all Parties. Any modifications of this Agreement must be in writing and signed by all parties. Each person signing as Client(s) below will be fully responsible for ensuring that full payment is made pursuant to the terms of this agreement. This Agreement will be governed by the laws of New York State.

COVID-19 Due to the current global outbreak of Covid-19 (also known as the Corona Virus, Coronavirus, Novel Corona Virus, SARS-CoV-2), the Photographer withholds the right to cancel or reschedule sessions without notice, limitation or justification. This is in line with the current WHO, CDC and Government recommendations in handling and containing the virus.

The client is expected to comply with current hygiene and safety advice recommended by health services and also must agree to and abide by any additional hygiene terms the photographer may send to the client prior to the session.

In the event the Photographer becomes unwell and is prevented from carrying out the booked session, the Photographer will make every effort to reschedule the session and the client understands the session will continue to be rescheduled until it is safe to be completed according to guidelines set forth by the CDC, WHO and Government recommendations.

In the event the Client becomes unwell and cannot attend the photography session, the Photographer and Client will make every effort to reschedule the session. The photographer understands the session will continue to be rescheduled until it is safe to be completed according to guidelines set forth by the CDC, WHO, and Government recommendations.

If anyone attending the session (including but not limited to: the Client, the Client’s child or anyone else) appears to have symptoms of the virus (including but not limited to: a cough, fever or respiratory symptoms, mild or otherwise) they will be asked to leave immediately, and the session will be halted without notice or restriction. If anyone in the Client’s household becomes unwell with respiratory symptoms (as listed above), the Client has a duty to make the Photographer aware of this prior to the session. Failure to do so could result termination of the contract with forfeiture of all monies that have been exchanged. Client acknowledges it is their responsibility to inform the photographer BEFORE their session of any known sickness, COVID-19 related or not, and that failure to do so leaves it up to the photographer as to the appropriate action that should be taken.

Client also releases the photographer of any and all liability should they, or any family members attending the session(s) should they contract the virus known as Covid-19 (also known as the Corona Virus, Coronavirus, Novel Corona Virus, SARS-CoV-2) and any other sickness.
